How the Mechanic’s Liens Process Works

According to state law, there is a certain process that suppliers and subcontractors must follow in order to get a mechanic’s lien. First and foremost, only a supplier or subcontractor who has not directly contracted with the homeowner may take out a mechanic’s lien.

The supplier/subcontractor typically must follow these steps:

  • Provide notice within 20-30 days of what he or she is contributing
  • After failure to receive payment, the supplier/subcontractor can file a claim of mechanic’s lien with the county in which services were rendered
  • A solution may be worked out with the homeowner within two to six months after the lien has been granted, or the supplier/subcontractor may file a lawsuit

Failure to meet the deadline for filing a mechanic’s lien can result in no further effect on the property. However, if you are a homeowner, it is still wise to clear your property of the mechanic’s lien via court order. This can help you avoid problems later on, should you choose to sell the property.
